Life cycle of the effectives of the Armed Forces after military career

Part of the life cycle of the Armed Forces personnel is the period of monitoring and treatment of the military personnel in reserve/release/retirement.

This is supported by the legal acts of the military status of the Armed Forces in Republic of Albania, as well as Law no. 10142, dated 15.05.2009 “On Supplementary Social Security of the Armed Forces Officers, Employees of State Police, the Republic Guard, State Information Service, Police, Prisons, Police, Fire Protection and Rescue Employees of the Internal Audit Service in the Republic of Albania”, amended by CM decision, 793, dated 24.9.2010, amended.

Under Article 7 of Law no. 10142, dated 15.05.2009, additional types of benefits are defined as follows: “Persons defined in Article 2 of this Law or their families provides additional benefits over those defined by Law no. 7703, dated 11.05.1993 “On Social Insurance in the Republic of Albania”, amended, for:

a) temporary incapacity to work and service

b) disease prevention;

c) medical rehabilitation;

ç) immediate reward and transition payment, when in reserve/release;

d) early retirement for seniority;

dh) supplementary payment, added to the full retirement age;

e) supplementary disability pension;

ë) Family supplementary pension

f) supplementary pension family when they die because of duty;

g) supplementary payments for funeral expenses.

Categories of servicemen who benefit are:

a) military in reserve who have completed the transitional payment and have 12 years of service for female and 15 years of service for male and reach the age of 42 for females and 47 for males.

b) military who have been in reserve before the date 27.06.2009, date of entry into force of the law no. 10142, dated 15.05.2009 and have completed the transitional payment after that date, and reach the age of 42 for females and 47 for males.

c) military who have been in release before 27.06.2009, date of entry into force of law no. 10142, dated 15.05.2009 and thereafter reach of the age of 42 years for females and 47 years for males.

d) Military who have been in early supplementary retirement and reached the age of retirement before the date 27.06.2009 date of entry into force of law no. 10142, date 15.5.2009.

e) Military who have been in reserve and have completed the transitional payment and reached the age of 42 for females and 47 for males, before the date 27.06.2009, date of entry into force of the law no.10142, date15.05.2009.

f) Military who have been in release and have reached the age of 42 for females and 47 for males before date 27.06.2009 date of entry into force of the law no. 10142, date 15.05.2009.

g) Military who have been in release and go in release after date 27.06.2009, date of entry into force of law no. 10142, date 15.05.2009 for health reasons certified by the forensic committee and benefit supplementary disability pension.

h) Families of military who died when they were and are on duty, reserve, release, and benefit early retirement pension and benefit early supplementary family pension

i) Military families who have lost and lose their lives on duty and because of it, family receives a supplementary pension.

Service time
Categories of beneficiaries, is determined by the law no. 9210, dated 23.03.2004 “On the military status of the Armed Forces of the Republic of Albania”.

Seniority in the service included:

a) Interruption career time due to a wrong order or decision, declared by a court;

b) The term of sentence of imprisonment or exile for political reasons, after titling career, from persons who have served in the structures defined in this law, when they have benefited by the law no.7514, dated 09.30.1991 “On innocence, amnesty and rehabilitation of former prisoners and politically persecuted”.
