The General Staff of the Armed Forces (GSAF) of the Republic of Albania, with regard to comments made by Rear Admiral Kristaq Gerveni to some media of the country, on the noncompliance of the administrative order of the Minister of Defence for the “Handover of assignment and return back to the country”, states that, the implementation of the order “is not debatable, but it is executable rapidly and precisely” according to the clause 5.2.2, article 2, section V of the Regulation on Life within Armed Forces, approved by order of Minister of Defence no. 1821, dated 09.11.2011.
From every military of the Armed Forces, regardless the ranks he holds, nature of the order content (unless the order goes significantly against the Constitution of the Republic), it is expected the receipt, clarification, implementation and reporting of its execution, while its superior is responsible for the given order and consequences its implementation brings.
We remind that in cases of disobedience and noncompliance of the order by the military that is obliged to execute and observe the order, it constitutes a penal contravention, while the case in question harms the image of the military and international dignifying representation of our militaries in Alliance structures.
For the military in question, there is another disciplinary practice and the General Staff, based on the applicable laws and regulations, has made its proposals and has taken appropriate measures.
The administrative order for the handover of assignment and return back to the country does not violate the competences of the President of the Republic, but it simply regulates relations between the employer and employee, since Mr. Gerveni’s three-year term in this office has expired.
